These Terms of Service govern your use of the AMAC MAZAO platform and services. By accessing or using our platform, you agree to be bound by these terms.

1. Agreement to Terms

By accessing or using the AMAC MAZAO platform, you confirm that you can form a binding contract with AMAC PLC, that you accept these Terms of Service, and that you agree to comply with them. Your access to and use of our Services is also subject to our Privacy Policy and Cookie Policy.

2. User Accounts

2.1 Account Creation

To access certain features of our platform, you must register for an account. You must provide accurate and complete information and keep your account information updated.

2.2 Account Types

• Exporters/Sellers: Kenyan agricultural producers and exporters
• Buyers: International buyers, primarily from Dubai and GCC regions
• Logistics Partners: Verified logistics service providers

2.3 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

3. Platform Services

3.1 Marketplace Services

AMAC MAZAO provides a digital B2B marketplace connecting Kenyan agricultural exporters with international buyers, primarily in Dubai and GCC regions.

3.2 Transaction Services

• Product listing and verification
• Order management and negotiation
• Secure payment processing through escrow
• Logistics coordination with DHL partners
• Quality assurance and certification

3.3 Service Modifications

We reserve the right to modify or discontinue any service feature at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Services.

4. User Responsibilities

4.1 Exporters/Sellers

• Provide accurate product information and certifications
• Maintain required quality standards (KEBS, WRSC)
• Ensure timely delivery of products
• Comply with all export regulations

4.2 Buyers

• Provide accurate import documentation
• Make timely payments through approved channels
• Comply with import regulations of their country
• Inspect goods upon delivery as per terms

4.3 Prohibited Activities

• Fraudulent or misleading listings
• Circumventing the platform's payment system
• Violating any applicable laws or regulations
• Infringing on intellectual property rights
• Harassing other users or platform staff

5. Payments and Fees

5.1 Transaction Fees

AMAC MAZAO charges a service fee on completed transactions. The current fee structure is available on our platform and may be updated from time to time.

5.2 Escrow Services

All payments are processed through secure escrow services in Dubai. Funds are released to sellers upon successful delivery and acceptance of goods.

5.3 Currency and Taxes

Transactions are conducted in USD or other agreed currencies. Users are responsible for all taxes, duties, and customs fees applicable to their transactions.

6. Intellectual Property

The AMAC MAZAO platform, including its design, logo, content, and software, is the property of AMAC PLC and protected by intellectual property laws.

Users retain ownership of their product listings and content but grant AMAC MAZAO a license to display and distribute that content on the platform.

7. Limitation of Liability

AMAC MAZAO acts as an intermediary platform and is not liable for:

• Quality of products traded between users
• Delivery delays or issues beyond our control
• User disputes or disagreements
• Force majeure events affecting transactions

Our total liability to you for all claims arising from these terms shall not exceed the total commission fees we earned from your transactions in the past six months.

8. Dispute Resolution

8.1 User Disputes

Users are encouraged to resolve disputes amicably. AMAC MAZAO may provide mediation services but is not obligated to do so.

8.2 Governing Law

These Terms shall be governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

9. Termination

We may suspend or terminate your account at our sole discretion if we believe you have violated these Terms or applicable laws.

You may terminate your account at any time by contacting our support team. Termination does not affect any rights or obligations that arose prior to termination.

10. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes through the platform or via email. Continued use of our Services after changes constitutes acceptance of the modified Terms.
